“(1) It shall be the general duty of every local authority (in addition to the other duties imposed on them by this Part)— (a) To safeguard and promote the welfare of children within their area who are in need; and (b) So far as is consistent with that duty, to promote the upbringing of such children by their families, by providing a range and level of services appropriate to those children's needs. (3) Any service provided by an authority in the exercise of functions conferred on them by this section may be provided for the family of a particular child in need or for any member of his family, if it is provided with a view to safeguarding or promoting the child's welfare. (6) The services provided by a local authority in the exercise of functions conferred on them by this section may include providing accommodation and giving assistance in kind or. . . in cash. (10)....“family”, in relation to [a child in need], includes any person who has parental responsibility for the child and any other person with whom he has been living.”
“5.2.4 Financial: Financial support can be agreed, if a need is indicated by the Child in Need Assessment. Subsistence payments are paid weekly, in line with local guidance. While guidance exists and will be relied upon, subsistence payments will be determined on a case by case basis considering the individual situation of the family. LBN can provide time-limited additional financial support, but requests must be made by the allocated case worker using Appendix 2. 5.2.6 Where a person states in writing that he or she is not satisfied that the rate paid meets the subsistence needs of the family and that a further sum is required to meet those subsistence needs, LBN will conduct an internal review within 21 days of receipt of that written request in order to determine whether any and if so what further sum is required. LBN will have the discretionary power to backdate any enhanced payment.”
