In addition, there is a statement from the defendant's mother ... "I am asked by the defence not to make a finding of fact that this defendant is a fugitive from justice. I cannot agree. It was quite clear to the defendant that the proceedings were not at an end in 2003 but that he had been granted bail with conditions. There is no evidence before me to show that he was told that he could leave Spain and return to the UK. Neither is there any evidence at all which would indicate that these proceedings had come to an end. Thus, I find that he is a fugitive from justice in Spain."
"This court would concede that on the face of it 4 years to complete the enquiries is an indication of a leisurely approach to investigation but I must bear in mind that there were apparently 12 credit cards from at least 8 countries other than Spain involved in this fraud and as I have already said 35 operations with them. This is not culpable delay."
