[1]MR JUSTICE SILBER: The Nursing and Midwifery Council seek an extension of the interim suspension order made against Matlhapi Mosiakgabo, the respondent, for a period of four months from 13 April 2011. The respondent had faced allegations that she failed to maintain the well-being and safety of Patient A in a number of different respects.[2]An interim order was imposed under Article 31(2) of the Nursing and Midwifery Order for a period of 18 months and was due to expire on 13 July 2010. This court extended the interim order for nine months until 30 April 2011. Unfortunately, the respondent has not participated with the applicant in the investigation. Initially the applicant received notification the respondent was represented by the Royal College of Nursing, but on 10 November 2009, the applicant received written confirmation that the Royal College no longer represented the respondent as they had not received further instructions.[3]The matter is now ready for a final hearing. It is due to take place for three days between 15 and 17 June 2011. The respondent has been served with a copy of the documents, but has not attended.[4]In those circumstances, I propose to grant the order to extend the period until 12 July 2011. The respondent has permission to apply to the court, on giving the applicant three days' written notice, to vary or discharge the order. No order as to costs.
