"Is the proposal "likely to have significant effects on the environment"? (likely being construed in this context as meaning 'potentially' or something similar). Again however this document post dates the relevant decision. Since it was not prepared in relation to the decision being taken as to the need for an environmental statement, I am not prepared to infer therefrom that the wrong test was applied in the relevant context. GVA Grimley's letter of the17th December 2009 quotes two relevant sections of Circular 11/99, both including the word "likely"
"Taken as a whole record, it was clear why it was considered that an EA was not required. Pre-request investigations on site relevant to consideration of environmental matters were material to the consideration along with site history and site context"
