“Whether, having regard, inter alia, to his right of election for trial by court martial, his right of appeal to the Summary Appeal Court, his subsequent appeal to the Summary Appeal Court and the decision in Thompson, the Applicant’s trial by way of summary dealing before his Commanding Officer was in breach of Articles 6(1) and 6 (3) of the European Convention on Human Rights.”
