"Paragraph 346 of the Immigration Rules states that representations will be treated as a fresh application if the claimant finds that the representations are sufficiently different from the earlier claim that there is a realistic prospect that the conditions set out in paragraph 334 will be satisfied. (4) In considering whether to treat the representations as a fresh claim, any material which is not significant or not credible, or was available to the applicant at the time when the application was refused, will be disregarded."
