"15. Using the internet to contact or attempt to contact any child known or believed to be under the age of 18; 16. Having any unsupervised contact or communication of any kind with any child under the age of 18, unless: i. it is inadvertent and not reasonably avoidable in the course of lawful daily life; or ii. supervised by the child's parent or guardian who has knowledge of his convictions; or iii. supervised by someone appointed by the child's parent or guardian, and the parent or guardian has knowledge of his convictions; or iv. where contact is unsupervised, it is with the consent of the child's parent or guardian who has knowledge of his convictions."
"It is my assessment that [the appellant] actually represents a medium risk of harm to children, particularly female children aged 7 to 14 years."
"I am afraid, in this case, I have got to ask myself do you present a risk of danger to the public? Not in the sense that it cannot be controlled. Appropriate punishment can only be achieved by immediate custody? The answer to that, I am afraid, is yes. That is, I am afraid, inevitable in cases such as this. The collection is so large and it has gone on for so long. You do not have a history of poor compliance with court orders but you do have a history of poor compliance with the law. Ten years is a long time to be breaking the law to advance your interest in little children. Is there a realistic prospect of rehabilitation? There might be; there might be. It is said that you are seeking help now; why you have not sought any help prior to your arrest in that ten year period I do not know. Your mitigation is there but it is not in the category of strong personal mitigation that would result in it being justified to the public that the sentence should be suspended, and in terms of immediate custody will result in significant harmful impact on others. The answer to that, I am afraid, is no. It will have an impact – of course it will – and your family and your children will serve this sentence with you in mind as you go through."
