“Statement of offence: Conspiracy to defraud contrary to common law. Particulars of offence: [The defendants] on divers days between the 5th day of November 1997 and the 20th day of July 2000 conspired together and with persons unknown to defraud Microsoft Corporation, Microsoft Limited, distributors of Microsoft products and their customers, by dishonestly: (i) Importing, distributing and selling in the course of business counterfeit Microsoft computer software and other Microsoft products which were infringing copies of copyright works; (ii) Importing and distributing and selling in the course of a business counterfeit Microsoft computer software the labelling and packaging of which was an infringing copy of copyright works; and (iii) Importing, distributing and selling in the course of business counterfeit Microsoft computer software, the labelling and packaging of which bore unauthorised and infringing copies of registered trademarks.”
