“There is no arguable error of law in Burnett J’s judgment. The Secretary of State was entitled to conclude as she did, both in respect of Article 3 and in respect of Article 8. Had the substantive merits of the case warranted a grant of PTA, I would have been prepared to grant the necessary extension of time, despite the lack of any real justification for the delay, but they do not.”
“Where treatment humiliates or debases an individual, showing a lack of respect for, or diminishing, his or her human dignity, or arouses feelings of fear, anguish or inferiority capable of breaking an individual's moral and physical resistance, it may be characterised as degrading and also fall within the prohibition of Article 3.”
