“I conclude that Deputy Judge Cook’s decision that the 1991 notice was still extant and that the tenant was entitled to rely on it for the purposes of ascertaining the relevant time of the exercise of his right to buy was wrong for the reasons that I have set out. In my view the issue was in fact determined by Judge Sleeman who was only asked to make a declaration on the basis that the valid and relevant notice was the 2001 notice. In the circumstances the appeal should be allowed and this Court should declare that the relevant time the Claimants exercised their right to buy was by the written notice served on2 July 2001 .”
