JUDGMENT

For the reasons given orally at the Hearing, the Tribunal decided as follows:[1]The claim of constructive unfair dismissal fails and is dismissed.[2]The claim of unlawful deduction from wages succeeds and the respondent shall pay to the claimant the sum of TWO THOUSAND THREE HUNDRED AND NINETY ONE POUNDS AND NINETY NINE PENCE (£2,391.99).[3]The claim for unpaid holiday pay succeeds and the respondent shall pay to the claimant the sum of ONE THOUSAND ONE HUNDRED AND NINETY EIGHT POUNDS AND SIXTY PENCE (£1,198.60). This is the gross sum. The respondent shall be liable to account to HMRC for any income tax or national insurance contributions which may be due on that sum before payment is made to the claimant.
