JUDGMENT
The claim is struck out under rule 38 of The Employment Tribunal Procedure Rules 2024 on the grounds of non-compliance with an order of the Tribunal and that the claim has not been actively pursued, in terms of rules 38(1) (d).REASONS
[1]On 03 October the Tribunal wrote to the claimant asking for information regarding why the claim had been lodged out with the 3 month time, no reply was received from the claimant. Further reminders were sent on 25 November 2025, 10 December 2025 and 06 January 2026 for the claimant to produce this information, but no replies to these letters were received.[2]A strike out warning letter was then issued on 19 January 2026 giving the claimant until 02 February 2026 to respond or give reasons why such a Judgment should not be issued.[3]The claimant has failed to respond or give reasons why such a judgment should not be made or to request a hearing. The Tribunal therefore strikes out the claim.
