REASONS
[1]The case called on 16 October 2025 for a preliminary hearing to deal with the claimant’s application for interim relief under Section 128 of the Employment Rights Act 1996.[2]The claimant did not attend and the respondent was represented by Mr Briggs, Advocate.[3]Upon enquiry by telephone call to the claimant it was established that the claimant was not attending and had decided to withdraw his claim for interim relief. This was confirmed by e mail received by the Employment Tribunal at 10.20 a.m. from the claimant. The claimant confirmed he was withdrawing his claim for interim relief but wished to continue with the remainder of his claim.[4]I have accordingly dismissed the claim for interim relief but without prejudice to the remainder of his claim which shall proceed.
