JUDGMENT
(1) It is an agreed fact that the claimant’s employment transferred from the respondent to Menzies Distribution on 1 June 2024 and that the Transfer of Undertakings (Protection of Employment) Regulations 2006 applied.(2) The effect of regulation 4 of those regulations is that the complaints against this respondent for arrears of wages and/or unlawful deductions from wages and/or unpaid holiday pay have no reasonable prospect of success. Case No.: 8002114/2024 Page 2(3) Therefore, they are struck out under rule 38(1)(a) of the Employment Tribunal Rules of Procedure 2024.(4) Oral reasons were given at the end of the hearing. Neither side requested written reasons.
