Mr B Millar v A Adey: 8001932/2024

EMPLOYMENT TRIBUNALS (SCOTLAND)
Case No 8001932/2024
Mr B MillarClaimantA AdeyRespondent
Employment Judge A KempDate 4 July 2025

JUDGMENT

The claim is struck out under rule 38 of the Rules contained in Schedule 1 of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013 on the grounds that the claim has not been actively pursued in terms of rule 38(1)(d).

REASONS

[1]On 07 February 2025 the Tribunal wrote to the claimant to provide further information as detailed in the Preliminary Hearing Note of that date, no reply was received in the designated time limit contained in the letter, so further reminder letters were sent on 17 February 2025 and 27 February but again no reply was received from the claimant.[2]A strike out warning letter was then issued on 9 May 2025 giving the claimant until 23 May 2025 to respond or give reasons why such a Judgment should not be issued.[3]The claimant has failed to respond or give reasons why such a judgment should not be made or to request a hearing. The Tribunal therefore strikes out the claim. Date Sent to Parties: 04 July 2025
