JUDGMENT

The claim is struck out under rule 38 of the Employment Tribunals Procedure Rules 2024 on the grounds that the claim has not been actively pursued in terms of rule 38(1)(d).

REASONS

[1]A letter dated 16/01/2025 was sent to the Claimant asking them if they intended proceeding with their Breach of Contract claim and if so they had to specify what contractual terms they relied on as having been breach by the respondent within 7 days. They were also informed that if no response was received then the breach of contract claim may be struck out under Rule 38(1)(d).[2]A further reminder letter was sent on 28/01/2025 instructing the claimant to reply to our original letter by 04/02/2025, as the Claimant has failed to respond or give reasons why such a judgment should not be made or to request a hearing. The Tribunal therefore strikes out the claim.
