JUDGMENT

The judgment of the Employment Tribunal is that the respondent made unauthorised deductions from the claimant’s wages under section 13 of the Employment Rights Act 1996 in omitting to pay the claimant his full annual leave under Regulation 14 of the Working Time Regulations 1998. The respondent was in breach of contract in not paying the claimant said wages due to him and for accrued annual leave pay. The Tribunal awards the claimant the total sum of ONE THOUSAND AND NINETY NINE POUNDS AND TWENTY PENCE (£1,099.20) gross, payable net by the respondent to the claimant after the respondent paying such income tax and national insurance contributions due on the wages payable to the claimant in respect of that amount.
