JUDGMENT
The claim is struck out under rule 38 of the Employment Tribunal Procedure Rules 2024 on the grounds of non compliance with an Order of the Tribunal dated 16 October 2025 in terms of rule 38(1)(c) and that the claim has not been actively pursued in terms of rule 38(1)(d).REASONS
[1]On 16 October 2025, the Tribunal postponed a preliminary hearing fixed for 17 October 2025 on the application of the claimant and issued orders requiring the claimant to send to the Tribunal and the respondent medical evidence. The claimant did not respond, and a subsequent reminder was issued on 17 November 2025.[2]On 19 December 2025 the Tribunal gave the claimant an opportunity to give written reasons by 12 January 2026 or to request a hearing in order to consider why the claim should not be struck out.[3]The claimant/respondent has failed to give an acceptable reason why such a judgment should not be made or to request a hearing. The Tribunal therefore strikes out the claim.
