JUDGMENT

[1]The Claimant’s claim that the Respondent’s termination of her employment contract (by dismissal) on 30 January 2025 was unlawful discrimination arising from disability under s.15(1)(a) of the Equality Act 2010 was presented in time.[2]Having not been presented on a timely basis, and the Tribunal having decided it is not just and equitable to extend time, the following claims are dismissed:a. harassment related to disability claim alleging breach of s.26 of the Equality Act 2010;b. failure to make reasonable adjustments claim alleging breach of ss.20-21 of the Equality Act 2010;c. all other claims alleging a breach of s.15(1)(a) of the Equality Act 2010.[3]It is noted that the Respondent now accepts that:a. at all material times(i) the Claimant had anxiety and depression which constituted a disability for the purposes of the Equality Act 2010(ii) the Respondent knew the Claimant had this disability;b. the Claimant had the impairment of delusional parasitosis, psychosis and PTSD which constituted a disability for the purposes of the Equality Act 2010 since about 15 June 2024, and the Respondent knew the Claimant had this disability by 14 October 2024. NOTE[4]Reasons for the decisions above were given orally at the hearing. Any request for written reasons must be sent to the Tribunal within 14 days of receipt of a copy of this Judgment. Absent a timely request, written reasons for those decisions will be provided only at the request of the Employment Appeal Tribunal or a competent court. A copy of this Judgment will be published on the Employment Tribunal judgment public website after it is sent to the parties.
