JUDGMENT

Rule 22 of the Employment Tribunal Rules 2024 No response has been presented to this claim and an Employment Judge has decided to issue the following judgment on the available material under rule 22: The respondent has made unauthorised deductions from the claimant’s wages and is ordered to pay the claimant the sum of £10,709.51 gross; in respect of i.Unpaid holiday pay of £2880 which is calculated as followsa. For 2022 of £288 (24 hours at £12 per hour);b. For 2023 of £1536 (being the sum underpaid calculated on an hourly rate of £16 rather than £12 per hour in relation to 8 days and 20 days leave paid at £12 per hour rather than £20 per hour); andc. For 2024 of £1056 being unpaid leave of 3 days at £16 per hour and 7 days and £12 per hour. ii.Unpaid wages of £2400 for the period from 11 March 2024 to 16 April 2024 being 40 hours per week at £12 per hour; and iii.Deductions made in respect of sums which were deducted from the claimant’s wages and not remitted to HMRC of £5229.51 calculated on the basis of 69 weeks’ employment and the sum of £75.79 which was unlawfully deducted each week.
