JUDGMENT
The claim is struck out under rule 38 of The Employment Tribunal Procedure Rules 2024 on the grounds that the claim has not been actively pursued, in terms of rules 38(1) (d).REASONS
[1]On 12 May 2025 the Tribunal were notified that the case had settled through ACAS, we e-mail the claimant on 24 July 20205 to confirm this and ask if they now wished to withdraw the claim, no reply was received. A further letter asking for confirmation of the position was sent to the claimant on 12 September 2025 but yet again no reply was received from the claimant[2]A strike out warning letter was then issued on 28 October 2025 giving the claimant until 11 November 2025 to respond or give reasons why such a Judgment should not be issued.[3]The claimant has failed to respond or give reasons why such a judgment should not be made or to request a hearing. The Tribunal therefore strikes out the claim. 21 November 2025
