JUDGMENT
The judgment of the Tribunal is as follows.(1) The complaint was presented outside the time limit defined by article 7 of the Employment Tribunals Extension of Jurisdiction (Scotland) Order 1994, or alternatively section 23(2) of the Employment Rights Act 1996.(2) Consequently, the Tribunal has no jurisdiction to hear the complaint and it must be dismissed. Case No.: 8001022/2024 Page 2(3) In those circumstances it is unnecessary to decide the other preliminary issue whether the claimant was an employee or a worker for statutory purposes.
