JUDGMENT

The claim is struck out under rule 38 of the Employment Tribunal Procedure Rules 2024 on the grounds that the claim has not been actively pursued in terms of rule 38(1)(d).

REASONS

[1]On 20 May 2025, the Tribunal issued a Case Management Order to the parties. The third part of the Order required the claimant to provide a statement setting out the details of his losses within 21 days. The claimant was reminded to provide a response to the order on 12 June 2025 and 25 June 2025. No reply was received.[2]During the same period, the claimant was invited to comment on the respondent’s application for postponement on 23 May 2025. The claimant did not provide any reply to the application and postponement was ordered on 10 June 2025. The parties were then invited to return a list of dates on which they would not be available to attend the relisted hearing. The claimant failed to provide any reply.[3]On 4 July 2025 the Tribunal gave the claimant an opportunity to give written reasons by 18 July 2025 or to request a hearing in order to consider why the claim should not be struck out.[4]On 23 July 2025, the Tribunal wrote to the claimant again recording his failure to reply to Tribunal correspondence, comply with case management orders and confirm that he still wished to pursue his claim. The claimant was informed that his claim may be struck out if he failed to contact the Tribunal by 5 August.[5]The claimant has failed to give an acceptable reason why such a judgment should not be made or to request a hearing. The Tribunal therefore strikes out the claim on the basis that it has not been actively pursued.
