JUDGMENT
The claim is struck out under rule 38 of the Employment Tribunal Procedure Rules 2024 on the grounds that the claim has not been actively pursued in terms of rule 38(1)(d).REASONS
[1]On 23 June 2025 the claimant was asked to provide a copy of any documentary evidence which would support his position the respondent was still trading up to the date of the claimant’s last date of employment. No reply was received.[2]The Tribunal issued a reminder to the claimant on 3 July 2025 and asked for a reply by 10 July 2025. The claimant failed to provide any reply.[3]On 14 July 2025 the Tribunal gave the claimant an opportunity to give written reasons by 28 July 2025 or to request a hearing in order to consider why the claim should not be struck out.[4]The claimant has failed to give an acceptable reason why such a judgment should not be made or to request a hearing. The Tribunal therefore strikes out the claim on the basis that it has not been actively pursued. 01 August 2025
