[1]The claimant’s claim for a protective award under section 189 of the Trade Union and Labour Relations (Consolidation) Act1992 (TULCRA), having been dismissed under Rule 52 of the Employment Tribunal (Constitution and Rules of Procedure) Regulations 2014 in a judgment dated 30 July 2024, cannot be considered by the Tribunal; and[2]The Tribunal does not have jurisdiction to consider the claimant’s claim of breach of contract it having been lodged out with the three month statutory time limit in Section 7 of the Employment Tribunal Extension of Jurisdiction (Scotland) Order 1996, and where the Tribunal could not be satisfied that it was not reasonably practicable to bring the claim within that time limit.REASONS
