JUDGMENT

The Judgment of the Employment Tribunal is that the claimant’s claim succeeds, and that the respondent is ordered to pay to the claimant the sum of TWO HUNDRED AND THIRTY FOUR POUNDS (£234).

REASONS

[1]The claimant presented a claim to the Employment Tribunal in which he complained that the respondent had unlawfully deprived him of arrears of pay, amounting to £234.[2]The respondent submitted an ET3 in which they did not dispute that the claimant was due to be paid this sum.[3]A Hearing was listed to take place on 21 July 2026 by CVP. The claimant appeared on his own behalf, and Mr Ali appeared shortly after the Hearing had started, by telephone, representing the respondent. ETZ4(WR)[4]Mr Ali confirmed, again, that the respondent does not dispute that the claimant is owed £234 in arrears of pay. It appears that he was concerned about being able to make payment, and wished to arrange a schedule for repayment. That being a matter which is outwith the jurisdiction of the Tribunal, I suggested that he contact ACAS to reach a separate agreement with the claimant.[5]The claimant’s claim therefore succeeds in full. The respondent is therefore ordered to pay to the claimant the sum of £234.
