JUDGMENT
The claim is struck out under rule 37 of the Rules contained in Schedule 1 of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013 on the grounds that the claim has not been actively pursued in terms of rule 37(1)(d) .REASONS
[1]No defence to the claim was lodged and so the claimant was asked to provide information about the sums sought from the respondent to allow the Tribunal to issue a judgment without a hearing. There was no response to this request.[2]The case, therefore, proceeded to a hearing listed for 1 August 2024 but the claimant did not attend the hearing. The Tribunal rang the telephone number provided by the claimant, but the number was not recognized.[3]On 1 August 2024 the Tribunal gave the claimant an opportunity to give written reasons by 8 August 2024 or to request a hearing in order to consider why the claim should not be struck out under Rule 37(1)(d) of the Tribunal Rules of Procedure on the basis that he was not actively pursuing the claim.[4]The claimant did not reply to that correspondence and so has failed to give any reason why such a judgment should not be made or to request a hearing.
