K Somerville v Ash Studios (Edinburgh) Ltd (Dissolved): 8000200/2024
JUDGMENT
The claim is struck out under rule 37(1)(d) of the Employment Tribunals Rules of Procedure 2013 on the ground that it has not been actively pursued.REASONS
[1]The respondent was incorrectly named in the claim form as “Ash Studio Ltd” but the claimant now accepts that the correct name is as shown above. The respondent company was dissolved on 19 December 2023. The claimant has not applied to have that company restored to the Register of Companies.[2]On 29 November 2024 the Tribunal gave the claimant an opportunity to give written reasons by 13 December 2024 why the claim should not be struck out on the basis that it had not been actively pursued. The claimant has not replied and has also therefore failed to give an acceptable reason why that should not happen. The claim is therefore struck out. M Whitcombe
