JUDGMENT
The claim is struck out under rule 37 of the Rules contained in Schedule 1 of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013 on the grounds of non-compliance with an Order of the Tribunal in terms of rule 37(1)(c).REASONS
[1]On 24 November 2022 the Tribunal ordered the claimant to provide a disability impact statement and schedule of loss by no later than 4pm on 8 December 2022.[2]On 20 December 2022 the respondent made an application to the Tribunal for the claim to be struck out in terms of rule 37(1)(c) of the Rules contained in Schedule 1 of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013 following the claimant’s failure to comply with the order dated 24 November 2022.[3]On 29 December 2022 the Tribunal gave the claimant an opportunity to give written reasons by 12 January 2023 or to request a hearing in order to consider why the claim should not be struck out. Case No: 8000031/2022 page 2[4]The claimant has failed to give an acceptable reason why such a judgment should not be made or to request a hearing. The Tribunal therefore strikes out the claim.
