JUDGMENT

[1]The name of the respondent is amended to MJE Holdings Limited (trading as Qubana).[2]Within section 23(4) of the Employment Rights Act 1996, it was not reasonably practicable for the claimant to present his complaint to the Tribunal within the period set out in section 23(2) and the claim was presented within a reasonable time thereafter. The Tribunal may therefore consider the complaint on the merits.[3]The claimant’s complaint that the respondent made an unauthorised deduction from his wages is well-founded. The respondent is ordered to pay to the claimant the amount of the unauthorised deduction in the sum of £935.04 gross, representing 126 hours worked at £12.21 per hour (£1,538.46), less the amount already paid to him by the respondent on 30 June 2025 (£603.42).
