JUDGMENT

[1]The Claimant’s claims for notice pay, holiday pay, arrears of pay and other payments are dismissed.

REASONS

[1]The Respondent is in voluntary liquidation and was not expected to attend.[2]The Claimant did not attend.[3]The Tribunal waited until 2.45pm when the hearing was listed at 2pm and the Claimant had not attended and no messages had been received by him to the Tribunal with any explanation for a delay. The clerk to the Tribunal called the Claimant’s mobile number (contained in his claim form) but there was no answer.[4]The Tribunal is satisfied the Claimant was aware of this hearing as he emailed the Tribunal last month asking for the hearing on 23 April to take place in person and not by video. This request was granted. Case No. 2302216/2019[5]In the circumstances, including consideration of the value of the claim, the Tribunal considered it was in the interests of justice and consistent with the overriding objective to proceed in the absence of the parties.[6]The Claimant was not present to provide the detail of his claim or the basis of the sums sought.[7]The claims were therefore dismissed.
