Following the hearing of oral evidence from the claimant and submissions from both representatives, the decision of the tribunal is that:(1) The respondent’s application to postpone the hearing is refused (Rule 32 of The Employment Tribunal Procedure Rules 2024);(2) The Response is struck out (Rule 38 of The Employment Tribunal Procedure Rules 2024);(3) The claim for unauthorised deduction of wages (s.13 Employment Rights Act 1996) succeeds. The respondent must pay to the claimant the sum of £12,318.13, gross. It will be for the claimant to account to HMRC for any tax payable.
