Upon it being recorded that the Claimant does not wish to pursue her claim for unpaid holiday pay It is the decision of Employment Judge G Duncan that:[1]The Claimant’s claim for unpaid holiday pay is dismissed on withdrawal.[2]The Claimant was unfairly dismissed by the Respondent. The Respondent is ordered to pay the Claimant a basic award of £6,820.[3]The Respondent is ordered to pay a compensatory award in the net sum of £10,000.[4]The compensatory award is subject to a 10% uplift due to the Respondent’s failure to act in accordance with the ACAS guidelines and shall pay the Claimant the sum of £1,000.[5]The Respondent shall pay the Claimant for loss of statutory rights the sum of £500.
