S Tegeilolo v Sunbear Care: 6031579/2025
JUDGMENT
[1]The claimant’s claim for unauthorised deductions from wages is dismissed under rule 47 of the Employment Tribunal Rules of Procedure 2024.REASONS
[2]The claimant was notified of today’s hearing via a notice of hearing, dated 9 September 2025, which was sent to the claimant via email. The notice of hearing informed the claimant that the matter was listed for final hearing at 10.00am today.[3]The claimant’s ET1 does not set out the detail of the wages which she says have been deducted. She has not complied with the Tribunal order to provide her documents and evidence in support of her claim to the Tribunal. The notice of hearing directed that she should do so no later than 7 days before the hearing today. Case Number: 6031579/2025[4]Mr Grech and Ms Farrugia attended the hearing on behalf of the respondent. My clerk called the claimant at 10am but there was no answer. She called again shortly thereafter and left a message. The claimant did not respond to that message.[5]Ms Farrugia informed me that the respondent’s most recent contact with the claimant was via email on 23 November 2025, when the claimant told Ms Farrugia via email that she would see the respondent in court on 5 December 2025.[6]In light of that information, I am satisfied that the claimant was aware that the matter was listed for final hearing today. She had not attended and has provided no explanation to the Tribunal about why she has failed to attend.[7]Accordingly, the claimant’s claim is dismissed. Approved by:
