JUDGMENT

The claim is struck out.

REASONS

[1]The Tribunal wrote to the claimant on 14 March 2026 warning them that the Tribunal was considering striking out the claim under Rule 28 of the Employment Tribunal Procedure Rules 2024.[2]The claimant was ordered to explain in writing before 28 March 2026 why the claim was not an abuse of process given it was duplicative of case 6025417/2025. The claimant replied to the Tribunal after that date (1 April 2026) referring to IT difficulties but had still not explained why his claim was not an abuse of process.[3]I am satisfied that the grounds for striking out the claim under Rule 38 apply, and that it would be in accordance with the overriding objective in Rule 3 to strike out the claim. This is because the claim is duplicative of a separate claim by the claimant and his allegations can be properly considered as part of that case, meaning there is no unfairness to the claimant in this claim being struck-out.
