JUDGMENT

The complaint for unauthorised deductions from wages is dismissed.

REASONS

[1]The claim was presented on the 6th of August 2025. The date the claimant stated his employment ended was 31st of January 2025. The ACAS EC certificate indicated it was received on the 11th of July 2025 and issued on the 28th of July 2025.[2]By section 23 of the Employment Rights Act 1996 a complaint for unauthorised deductions from wages must be presented within 3 months from the date of the deduction or, if it was not reasonably practicable to present it in that period, within such further period that was reasonable. There is no evidence that the latter circumstance arose. The claim is out of time. Approved
