However, nothing within that detail demonstrates that the claimant has a type of unfair dismissal claim that is exempt from the 2-year requirement under s108 of the Employment Rights Act 1996 ("ERA"). In other words, the Tribunal has no jurisdiction to hear the claim of "ordinary" unfair dismissal pursuant to s98 ERA, given that the claimant had worked for the respondent for less than two years.
