JUDGMENT

[1]The Claimant’s complaint of unauthorised deductions from wages is well- founded.[2]He is awarded the sum of £634.92 gross payable by the Respondent. This is in respect of 52 hours’ work payable at the rate of £12.21 per hour, the amount of the National Living Wage then in force.[3]In addition, the Claimant is awarded the sum of £976.80 gross payable by the Respondent, which is in respect of two weeks’ pay calculated at 40 hours per week multiplied by £12.21 per hour. This award is made under section 38 of the Employment Act 2002 and is compensation for the failure by the Respondent to provide him with written particulars of employment at the start of his employment.[4]The total award of compensation is £1611.72 gross.
