JUDGMENT

Is it the judgment of the Tribunal that: The claim is dismissed.

REASONS

[1]The claim was presented in the Bristol Employment Tribunal on 25 July 2025. The Claimant brought claims for unfair dismissal, age discrimination, redundancy payment, notice pay, holiday pay and arrears of pay. The respondent failed to present a valid response on time. It is in creditors’ voluntary liquidation.[2]The Claimant’s claims for redundancy payment, notice pay, holiday pay and arrears of pay have been satisfied in full by payments from the Redundancy Payments Service.[3]The liquidators of the Respondent have informed the Tribunal and the Claimant that there are no funds held in the liquidation estate.[4]The Tribunal wrote to the Claimant on 28 April 2026 and 22 May 2026 asking for confirmation as to whether any claims were still pursued in light of the above. The Claimant wrote to the Tribunal on 23 May 2026 saying that he wished to proceed with the unfair dismissal and age discrimination claims because it was important for him “to ensure that my personnel records accurately reflect the circumstances”.[5]Notice of today’s preliminary hearing (for case management) had been sent to the parties on 27 September 2025. The Tribunal’s letter of 28 April 2026 reminded the parties of the hearing. The hearing was due to start, by telephone, at 10am. The Claimant did not attend and no explanation was given. Attempts were made by Tribunal staff to contact the Claimant by telephone and email without success. By 10.30am the Claimant had still not attended the hearing.[6]The claim is dismissed pursuant to Rule 47. Approved by:
