JUDGMENT

[1]The claimant’s claim for breach of contract is well founded.[2]The respondent shall pay to the claimant the gross sum of £25,000 as damages for breach of contract.[3]The sum awarded to the claimant has been calculated as follows: 3.1 The claimant was dismissed on 6 February 2025. The claimant was contractually entitled to six months’ notice pay, but was only paid one month’s notice pay. The claimant claimed the balance of five months’ notice pay which was owed to him (£91,666.67). Although the claimant’s claim for five months’ notice pay succeeded, Article 10 of the Employment Tribunals Extension of Jurisdiction (England and Wales) Order 1994 sets a maximum limit of £25,000 for damages awarded by an Employment Tribunal in breach of contract claims.[4]No uplift is awarded to the claimant pursuant to section 207A of the Trade Union & Labour Relations (Consolidation) Act 1992.[5]The respondent shall pay the sum due to the claimant on or before 4 February 2026.
