[1]The Tribunal wrote to the Claimant on 16 September 2025 warning her that as she did not have the requisite two years qualifying service for claiming unfair dismissal her claim might be struck out. She has set out reasons in a letter of the same date as to why she says the two year qualifying period should be waived in her case. The Tribunal does not have discretion to waive the two year qualifying period and applying rule 38 of the Employment Tribunal Procedure Rules her claim must therefore be struck out as having no reasonable prospect of success.
