JUDGMENT
[1]By consent, the claimant’s application for interim relief is well-founded and is granted.[2]A continuation of the claimant’s contract of employment pursuant to section 130 Employment Rights Act 1996 is ordered.[3]The claimant’s contract of employment continues in force for the purposes set out in section 130(1) Employment Rights Act 1996 from 20 June 2025 until the determination or settlement of the complaint.[4]By agreement, the level of pay for the purposes of the continuation order has been calculated at 70 hours per week at the current national minimum wage (being £12.21 per hour). The claimant reserves the right to argue at any final hearing that he was contractually entitled to a higher sum with reference to the hourly rate set out in his monthly payslips.[5]The respondent must by 25 July 2025 pay the claimant the sum of £2,049.20 in respect of payments which the claimant could reasonably have been expected Case No: 6023361/2025 Page 2 of 2 to earn during past pay periods from 21 June 2025 to 11 July 2025, this figure having been reached using the formula as set out at paragraph 4 above.[6]The respondent must pay the claimant the sum of £2,732.27 every four weeks during the period from today’s date until determination or settlement of the complaint, this figure having been reached using the formula set out at paragraph 4 above.
