The claim is dismissed.REASONS
[1]By a letter of 13th August 2025, the Claimant was warned that Employment Judge Smart was considering dismissing his claim under rule 47 or striking it out under rule 38. The letter set out the Judge’s reasons for this. The Claimant was given until 18th August 2025 to put forward any objection.[2]The Claimant did not put forward any objection, within the time permitted or at all. Nor has he replied to the letter or otherwise communicated with the Tribunal.[3]I have decided to dismiss the claim pursuant to rule 47, for the reasons previously given by EJ Smart.[4]Further and alternatively, I would in any event have struck out the claim under rule 38 for the reasons given by EJ Smart, and also because the Claimant has failed actively to pursue his claim.[5]The Hearing listed on 4th November 2025 is vacated.
