JUDGMENT

[1]The following complaints are dismissed on the basis that the Tribunal does not have jurisdiction to hear them:a. All complaints of breach of the Health and Safety at Work etc Act 1974.

b. All complaints of breach of the Respondent’s duty of care in respect of the Claimant’s physical and mental health.

[2]This Judgment shall not prevent the Claimant from relying on factual matters said to establish failure on the part of the Respondent to comply with its obligations in relation to health and safety or its duties to her as her employer, in so far as relevant to her complaint of unfair dismissal or her complaints under the Equality Act 2010 and including in relation to remedy should any of those complaints succeed.
