JUDGMENT

The claim was presented in the Leeds Employment Tribunal on 17 December 2024. The respondent has failed to present a valid response on time. The Employment Judge has decided that a determination can properly be made of the claim, or part of it, in accordance with rule 22 of the Rules of Procedure.[1]The Tribunal declares the respondent made unauthorised deductions from the claimants’ wages. The respondent is ordered to pay the claimant the gross sum of £139.60. This consists of:a. A gross sum of £40.26 in relation to a shortfall in wages for September 2024 paid at the incorrect hourly rate of £11 per hour instead of the correct rate of £11.44 per hour; andb. A gross sum of £99.34 in relation to unpaid wages for 1 day (£11.44 per hour x 8 hours 41 minutes).[2]The respondent has failed to pay the claimant’s holiday entitlement and must pay the claimant the gross amount of £425.95 (£11.44 per hour x 37 hours 14 minutes).[3]The hearing listed on 03 June 2025 is cancelled.
