REASONS
[1]The respondent company is in compulsory liquidation. The winding-up order was made on 28 January 2025, and the consequent stay of these proceedings was notified to the parties on 4 March 2025. The permission of the court has not been obtained for these proceedings to be continued as required by the Insolvency Act 1986.[2]On 4 March 2026 the Tribunal gave the claimant an opportunity to give written reasons within 14 days why the claim should not be struck out as it had not been actively pursued. The claimant has failed to respond with any reasons.[3]In all the circumstances, it is in accordance with the interests of justice and the overriding objective to bring this claim to an end because it has not been actively pursued. The claim is therefore struck out, applying Rule 38(1)(d). Approved by:
