JUDGMENT

The claimant’s claims are dismissed.

REASONS

[1]The claimant presented a claim for unpaid salary by a claim form received by the Tribunal on 10 December 2024. The claimant had commenced Early Conciliation on 6 November 2024 and the Early Conciliation Certificate was issued on 11 November 2024. The claimant indicated in the claim form that her employment had terminated on 28 February 2024.[2]On 2 September 2025, the Tribunal wrote to the claimant: It appears that your claim was not presented within the three- month time limit set out in section 23 of the Employment Rights Act 1996 (as extended by the Early Conciliation period). Could you please write to the Tribunal by 4 pm on 8 September 2025 setting out whether you say it was not reasonably practicable for you to present your claim in time, and, if so, why. Please also explain what you are claiming and how you have calculated the figure. If you fail to respond, your claim may be dismissed as having been presented out of time.[3]The claimant has not responded. Her claim was presented out of time and there is no evidence on the basis of which time could be extended. The Tribunal therefore has no jurisdiction to hear her claims.
