JUDGMENT

[1]BY CONSENT time for presentation of the second respondent’s notice of appearance is extended until 18 June 2025.[2]The claimant was not an employee of the first respondent within the meaning of section 230(1) and (2) of the Employment Rights Act 1996.[3]The claimant was not an employee of the first respondent for the purposes of the Employment Tribunals Extension of Jurisdiction (England & Wales) Order 1994.[4]The claimant was not a worker of the first respondent within the definition in section 230(3) of the 1996 Act and regulation 2(1) of the Working Time Regulations 1998.[5]Because of the findings in paragraphs 2, 3, and 4 the claims against the first respondent for a redundancy payment, for a payment in lieu of notice, and a payment of accrued but untaken holiday pay fail and stand dismissed.[6]Because of the findings in paragraph 2, the claims against the second respondent brought pursuant to Parts XI and XII of the 1996 fail and stand dismissed.
