JUDGMENT
[1]The complaint under section 189 of the Trade Union and Labour Relations (Consolidation) Act 1992 is well-founded.[2]The Tribunal orders the Respondent by way of a protective award under section 189(3) of the 1992 Act to pay the Claimant, a payment equivalent to remuneration for the period of 90 days commencing 26 February 2025.[3]The Claimant’s gross weekly pay is £679.89. (which has been calculated in accordance with ss 220 to 229 Employment Rights Act 1996).[4]Thus the protective award is £679.89 x 12.86 weeks = £8,743.39.[5]The Employment Protection (Recoupment of Jobseeker’s Allowance and Income Support) Regulations 1996 apply to this award.
