JUDGMENT
[1]The Respondent’s application to strike out the claims of direct race discrimination and harassment related to race under Rule 38 (1)(a) because they have no reasonable prospect of success or Rule 38 (1)(c) because the Claimant has not complied with a Tribunal order is refused.[2]The claims of direct race discrimination and harassment related to race were not however presented within the applicable time limit. It is not just and equitable to extend the time limit. The race discrimination claims are therefore dismissed.
